Police on Tuesday arrested a 20-year-old suspected gang member for accidentally shooting a teenaged girl last week and then covering the incident up.

David Espinoza, an alleged Norteño gang member, is charged with street terrorism, making a false report to a peace officer, concealing a crime scene, being a gang member in possession of a handgun, contributing to delinquency and negligent discharge of a firearm, Tracy police Sgt. Tony Sheneman said.

He was booked into San Joaquin County Jail in French Camp.

On March 24, a 17-year-old girl with a shooting wound to her abdomen told police she had been the victim of a random drive-by shooting on the 1300 block of West 12th Street.

Police later found that Espinoza was allegedly showing the girl the gun when it accidentally fired, Sheneman said. The girl was treated for her non-life-threatening injuries at the hospital.

This is pretty stupid.everyone posting negative stuff on here just need to stfu. your all a bunch of ignorant fuks. it just sickens me to know that theres a bunch of people out there that dont hesitate to judge without even knowing someone. BUT THANKS TO ALL WHO HAVE BEEN DEFENDING DAVID OR TO ALL WHO ARENT QUICK TO JUDGE ONES CHARACTER! until you dont get to know him or even meet him, and know his personally and know what kind of a good hearted person he is then you have no right to say anything. most of you are just on here cuz your life right now is pretty worthless, and can only entertain themselves by sitting their ass on a chair and talk shit by typing it out. that makes you guys real badasses by the way. buti know that none of you would actually say shit like this to someones face if you had the chance. and its people like YOU guys that made this world the way it is! forget what all you ignorant worthless aholes. you dont know anything, you dont know the real story, and most of all you dont know him as a person. so why dont you all just do yourselves a favor n just go jump off a bridge. cuz u dont do anything good for this world anyway. eff u all.

STAR209, Okay I agree with you that someones race is not important here, but since you give the impression that you do know the real story, why not tell us ? And could you please do so without the cap lock on, it'll make it much easier for the reader.

I THINK ALL OF YOU GUYS ARE MORE FOCUSED ON THAT FACT THAT HE WAS HISPANIC WHEN THAT HAS NOTHING TO DO WITH IT.. HIS LAST NAME DONT MEAN SHIT.. AND THE FACT THAT YOU GUYS THINK HE IS AN IMMIGRANT SHOWS THAT YOU DONT KNOW ANYTHING ABOUT WHATS REALLY GOING ON.. SO FOR ALL YOU RETARDED ASS PEOPLE WHO DONT KNOW WHAT YOUR TALKING ABOUT I WOULD JUST SHUT MY MOUTH NOW IF I WAS YOU.. IT WOULD BE SMART OF YOU TO GET THE REAL STORY AND THEN TALK ABOUT IT..

Your right TracyCitizen, Rodney is a proud graduate of Celebrity Rehab :)

And Chris, uh, who was cleaning those toilets and picking vegetables before them? The Irish, Italians, Chinese? The "minorities" of eras gone by? It wasn't too long ago those "No Irish Allowed" (or Chinese, or 'Coloreds') signs were apart of our society. My point is that it was not the middle class of that time, just as it isn't now (generally speakng of course). The core incident of this article was a punk gangbanger who shot someone and was arrested.

"Stereotypes exist for a reason."

Right, to perpetuate hatred and bitterness in our society.

LOL@ RD Runner~

In Rodney's defense, it is my understanding that he has been clean & sober for over a year. ;)

As a person who has been to many parts of Mexico over the past 20 years, I can assure you that most illegals who are here cleaning toilets for a living are grateful for the opportunity. In Mexico the large toy manufactuer MATTEL (which left the United States) pays employees $1.00 an hour. Why would'nt you want better for yourself and your family?

I don't know what the answer is, I really don't. But I just can't put down a person who wants better and is willing to work for it.

Uh people were mopping, cleaning, and doing all the stuff illegals were doing before they even came here. Its not like these jobs were never being done before.

But what illegals have done is they come in and undercut american labour and are standard of living. And this would not be happening if they all came to this country legally.

Half this town was built buy carpenters with fake social security numbers. Seriously, grew up as a teen ager here, ask the people in home building, its true.

I thought Rodney King said, "Can't we all just get a bong?"

On a serious note, I think that any police officer would tell you that many women (and men) would, will, and have, lied on behalf of their significant other. Even after they've been shot, stabbed or beaten to a pulp. We could go on and on about the reasons why, but it does happen. White, brown, black, people of all races and backgrounds have done it. Ask Tiger Woods.

I don't agree with the 'stealing our jobs' comment. I've yet to see anyone other than Hispanics scrubbing the toilets and mopping the floors at my place of business in over twenty years. Tcy1 you make a valid point, that people should commit to their education and make a place for themselves in society where the can live above the poverty level. If they don't, that's their choice. Those janitors I mentioned have always greeted the rest of us with a pleasant "hello" and continued with their duties. I've never heard any of them complain about their lot in life.

While I truly wish them (and all others working menial jobs) the best, the fact is that we as a society, need people in all stations of the workforce. Not all of us can be doctors, teachers, cooks, cops or whatever else. We DO need people cleaning, mopping, picking vegetables. Those working in those capacities provide services the rest of us would sorely miss if they weren't here.

Chris~

I can appreciate the reason you sterotype. I know most of us can be guilty of that. Over the course of 55 years, my entire family and I have been violated (5 various crimes, 2 violent) by 2 hispanics, 2 african americans, 1 caucasion. If I held these crimes against the entire race of these 3 groups, it would be a pretty lonley place for us to live our lives.

As Rodney King said so well..."Can't we all just get along?"

Stereotypes exist for a reason. Everytime there has been trouble in my neighborhood, including now, it almost directly corresponds with latino gang members or latinos from the bay area moving into the neighborhood. I've been living in the same home for 10 years and this happens like clock work every time a house in the neighborhood goes up for rent..

infact i witnessed some latinos fleeing the scene of a crime (vandalism of a car window) in my neighborhood last night, i called the police, they came, were not much help but at least they showed up.

Signed

TCY1~

I completely agree with you...emphasis on education for hispanics (and all races) is the sure way to have any positive progress in our world.

My father came to California from Mexico when he was 7 years old. He lived with an aunt he had never met. He was speaking fluent english within a year and had a B or better average. Before school he worked in the fields, and after school he did the same until he graduated from high school. He got a job driving a bus and continued his education. In 3 years he got hired digging ditches for PG&E. He continued his education. He had a wife, 3 kids, a mortgage and a car he owned out right. By the time he had retired he was a part of the management team for PG&E.

With hard work, a thirst for education he was able to enjoy the American dream. I learned first hand from this amazing man how important education and commitment to his family AND hard work is...

Star 209~

Do you talk to your mother with that mouth? By the way, I do not or will ever own a Mercedes. My 2003 paid off American made car is just fine with me...

First of all.. for those of you that automatically judge this kid (or "another punk kid," as some of you like to say)know the facts and know the people involved, instead of just reading the Tracy Press and making a judgement. Everyone knows that sometimes even newspapers are wrong. Look at The Tri Valley Herald as well as the Tracy Press and you will find that the info on this incident have different details between the two papers... And for those of you that profile him as an immigrant you obviously don't know him, which in turn means you probably don't know what really happened. You read his last name and just assumed, so get rid of your prejudice opinions and find a life because you are no better than anyone else based on the color of your skin or for that matter what your last name is....SO DON'T BE SO QUICK TO JUDGE SOMEONE BASED ON WHAT YOU READ!

TCY1- right on

Star209- hopefully you'll be less angry when you grow up. In all liklihood, if you see someone in Tracy sitting in a mercedes, they've earned it.

As for 12th street, and most of the surrounding area, including downtown Tracy, it really isn't an area to be that proud of.

I hope the girlfriend that lied to the police is prosecuted.

To Storkpmny~

You accuse hispanics of stealing "our" jobs. I challenge you to find 3 caucasion citizens between the ages of 18-30 willing to pick strawberries from 6am to 3pm for minimum wage.

I have NEVER seen causcasion men in front of the Home Depot at 7am looking for work...have you????

Your claim that hispanics are stealing jobs from Americans is old and tired. Only when Americans are willing to do this dirty work will your statement ring any truth...

On another note...I want to thank the Tracy Police for their hard work and commitment to making Tracy a safe city once again.

And it happened on west 12th street, oh theres a surprise, since that part of town is so lovely and all.... says ChrisRoberts

Not all of W. 12th street is horrible. You and your generalizations make me sick to my stomach. I agree the story was going to end up this way but a girl of any race can very likely lie for her boyfriend. You sound like a very angry individual.

Latina girl gets shot and does not cooperate with police. Way to go TRACY PD. Good to see they are following up on their cases instead of being lazy like they were with that Huckabee lady who killed that little girl.

Good to see they are learning from their mistakes.

As for these two clowns. Hmm I remember that original tracy press story. A latina teenager gets shot, goes to hospital, does not cooperate with police....

is anyone surprised here at the outcome.

We all knew she was protecting someone from the get go.

How low class can you get.

And it happened on west 12th street, oh theres a surprise, since that part of town is so lovely and all....

Makes no difference if the guy's pink, anyone who shows a gun to someone else without the safety on is just 'too stupid to be a crook'! What's that old saying, 'guns don't kill people, people kill people'? The young lady is just plain lucky she's still on this earth because the bullet could have easily hit a vital organ or artery.
