Huckaby attorney tries to get evidence tossed

Melissa Huckaby’s lawyer next month may ask a judge to throw out some evidence against her because Tracy detectives might have violated her rights prior to her arrest last year.

According to court records, Tracy Police are investigating whether their own detectives last April broke rules in talking to Huckaby, who is charged with the rape and murder of 8-year-old Sandra Cantu. Huckaby faces the death penalty if convicted.

Huckaby’s public defender Samuel Behar said in papers filed Jan. 25 that he was told by prosecutor Tom Testa that “several” Tracy police detectives “are being investigated” to see if any “internal rules were violated in connection with Det. Nate Cogburn’s comments to Huckaby” on April 10, hours before her arrest.

Whatever Cogburn said is unclear. A judge last year ruled a gag order on the case.

Tracy Police spokesman Sgt. Tony Sheneman would not comment.

Behar said her statements to Det. Tim Bauer on April 10 were used to authorize search warrants, but should could be thrown out if her rights were violated, the motion says.

Huckaby is charged with the kidnapping, rape and murder of her eight-year-old neighbor Sandra, whose body was found last year stuffed in a suitcase floating in a dairy pond. Both Huckaby and Sandra lived in the Orchard Estates Mobile Home Park, and Huckaby is awaiting an October trial date while being held at San Joaquin County Jail.

Last October, Behar filed a motion to suppress evidence against his client. A hearing was set for last month, but Behar was granted an extension until April 12.

Behar also wrote in his motion he needed more time because he and attorney Michael Burk have yet to see all the physical evidence in the case.

He wrote he’s waiting to receive a list of all property seized during the investigation against Huckaby, and he needed more time for other reasons not to be disclosed to the public.

An April 12 hearing is scheduled when Behar and Testa will argue over evidence.

The Detective is on “Admin leave” for a suspected violation of department policy? Anyone wonder what would happen if the police became more reluctant to do their jobs? Look at the BART cop, who I’m sure made a tragic mistake. He is looking at murder. He is being treated just like Huckaby, but all he did was show up to a disturbance. Cops are human and are prone to mistakes. As long as they are honest mistakes we need to move on.

When politics get involved the rules become convoluted and the standards gray. For instance, we would charge a drunk driver with vehicular manslaughter for killing someone in a DUI car wreck, but we charge a cop with murder for responding to a call for service? The difference is the drunk was doing something illegal to begin with. The cop was doing what you paid him to do.

If your police are not safe to do their jobs without fear of prosecution, then you are not safe. The cops will spend more time worrying about covering their behinds then they will about protecting yours.

The BART trial is supposed to end this week. Remember the Rodney King riots? What if the cops are scared to react when it hits the fan this time? Anyone taking BART to work on Friday?

Leave the detective alone, I’m sure he made a mistake during a very emotional incident and learned from it. It’s not like he is being accused of beating a confession out of her. Save my tax money and put him back to work.

Protectors have a flavor for freedom that the protected will never know.

Shoddy police work? Maybe? Tracy Press reported a suspect was in custody for the Cotton homicide, but has been since released by the district attorney.......hmmmm, what happened?.

The tracy press reported police basically ignored Huckaby drugging that kid and blamed the mother.

Isn't there still a couple of unsolved homicides that happened in this city??????

Who was voted officer of the year? And who did the voting?

Just so unbelievable, is there something in the water that affects lawyers' sense of right and wrong, the evidence is there.... is this an indication there weren't enough evidence?

Any evidence on how much the lawyer made so far?

How much publicity has he gained?

This unfortunately shows continuous pain the Cantu family must be endure, courtesy of the lawyer!

Hope the Memorial will speak volumes of injustice?

Sam Behar caught a case that will make him kinda famous so expect the little twerp to drag this case out for 5 years or longer. The longer he can nit-pick at the evidence the longer he is in the lime-light. He and the "helper" he has out of San Francisco are two peas in a pod. They will prove to be disgusting. Mark my words.

Yes, let's go after the detectives in this case that worked countless hours looking for Sandra and then her killer. We all know it is the criminal who has all the rights. While I realize this is the public defenders job, who was protecting and defending little Sandra from Melissa? We all pray there is justice for both Sandra and Melissa.

You know that as a parent we need to all support our police officials while they work feverishly to find our children. I recently had a huge scare with my child missing for several hours. I am so thankful that the SJ Sheriff worked every angle and searched for my child..It should not matter how they get to the bottom of the case what really matters is they are doing everything they can for the saftey and well being of the child and remember to catch the resposible person or persons. If this was your child you would feel the same way...I APPLAUD the police for doing their jobs...Risking their lives daily in a society where anything could happen at any time..

This is a parents worst nightmare and I hope you never have to feel the pain of not knowing where your child is, even though you trusted the person they were with..I'm the lucky one, Sandra's parents and grandparents have to try somehow to live through the loss of a child...

determine people rights or the criminals rights? Walk in the shoes of the victim and their family and I am sure you will change your mind.

You have to give people their rights before you drill them for information. The judge will determine this in a court of law.

Time will tell how good the Detective work was on this case....

We don't know all the details of what happened with the mom of the girl that was drugged so instead of trying and executing a very good and dedicated police detective who tirelessly worked on the Sandra Cantu case, why don't we just trust that the police do know what they are doing. We don't know what drugs were found in the house of this mom, her statements to the neighbors about her daughters behavior before she was drugged and possible other people who could have drugged the child other than MH. We DO know that the mom in question had a history with the police and it wasn't that much of a stretch to think she possibly had something to do with it herself. So Concerned Parent, instead of deciding that you know more than the people involved, why don't you give Nate Cogburn the benefit of the doubt? Not all the info on this case has been released and also hindsight is 20/20. From what I know, Det Cogburn came to an appropriate conclusion since there were multiple ways the girl could have been drugged and he didn't know any other details about MH at that time.

I want to applaud Nate Cogburn and thank him for all his tireless efforts when it comes to keeping the kids in Tracy safe. It is a thankless job and people criticizing when they don't know all the facts is I'm sure frustrating for all those involved in this case. We should all have faith that they did the best they could with the info they had at the time.

LAM75, I agree with you, your right. I know that's the job of the public defender, and besides we sure don't want anything overturned later because she could claim she didn't get a proper defense.

I plead guilty to reacting with my heart instead of my head after I read the story, but I do feel totally confident that in the end justice will be served for both Sandra and her family.

Let's not forget that Cogburn is the detective that wouldn't investigate Huckaby when she kidnapped and drugged the first little girl, in January for her "trial run." Instead he accused the child's mother of drugging her own daughter because she had beer on her breath.

Imagine what might have been, or not been, had Cogburn investigated Huckaby two months before Cantu disappeared?

Perhaps this guy is more trouble than he's worth?

Ok. That is a public defenders job. Trying to make the good guys guilty, I guess. I'm positive, however, that evidence that proves Huck's guilt will not be thrown out.
