The Feb. 12 rollover crash killed front seat passenger Kevin Merritt, 52, who was living in San Jose.
Highway Patrol spokesman Bob Rickman said he’ll later this week ask the San Joaquin County District Attorney to seek the felony charge and a misdemeanor charge of driving on a suspended license against the 44-year-old driver, who Rickman identified as Horace Booker, III, who was mildly injured in the crash.
The man was speeding westward in a gold Mercedes on 11th Street between Chrisman Road and the railroad overpass when the car veered to the right and flipped at least six times, a witness said.
Merritt was not wearing a seat belt, was ejected from the car and died on scene. A 12-year-old Tracy girl in the back seat who wore no seat belt was also thrown from the car. She was flown by helicopter to University of California, Davis, Medical Center.
A 35-year-old Tracy woman was taken by ambulance to San Joaquin General Hospital.

Makes you wonder just how many your sharing the road with who also have theirs suspended. One would think that those that do would not speed or do anything to draw attention to themselves. These knuckleheads never cease to amaze me.
I hope they recover. My thoughts are with them. Ihope they learn to wear seatbelts from now on.
