California Highway Patrol expects this week to ask a felony vehicular manslaughter charge to be filed against a Tracy man behind the wheel during a fatal car accident earlier this month.

The Feb. 12 rollover crash killed front seat passenger Kevin Merritt, 52, who was living in San Jose.

Highway Patrol spokesman Bob Rickman said he’ll later this week ask the San Joaquin County District Attorney to seek the felony charge and a misdemeanor charge of driving on a suspended license against the 44-year-old driver, who Rickman identified as Horace Booker, III, who was mildly injured in the crash.

The man was speeding westward in a gold Mercedes on 11th Street between Chrisman Road and the railroad overpass when the car veered to the right and flipped at least six times, a witness said.

Merritt was not wearing a seat belt, was ejected from the car and died on scene. A 12-year-old Tracy girl in the back seat who wore no seat belt was also thrown from the car. She was flown by helicopter to University of California, Davis, Medical Center.

A 35-year-old Tracy woman was taken by ambulance to San Joaquin General Hospital.

Common people, what is wrong with you... be a good example to children and also teach them how important wearing a seat belt is. Most injuries could have been avoided by this easy step. Who cares if you trust the person driving... realize all the other people on the road you don't know. Horrible, that is all I have to say. That poor girl could have died... thank god she didn't.

STILL no information on the status of the 12-year old girl? They are just copy/pasting from the previous story. Is there an update on her?

Adults can make their own decisions, right ones or be it wrong. I am more worried about the little dog that survived that crash, did somebody get that little guy home? Or was he just left wondering to be homeless pup now? Any body know?

He was driving with a suspended license.

Makes you wonder just how many your sharing the road with who also have theirs suspended. One would think that those that do would not speed or do anything to draw attention to themselves. These knuckleheads never cease to amaze me.

Two thoughts, slow down and wear your seatbelts. Isn't it common sense to wear your seatbelt by now?

I hope they recover. My thoughts are with them. Ihope they learn to wear seatbelts from now on.

I remember reading of this earlier. Are there any updates of how the girl and woman are?
