Police said he was still uncooperative, and he told an officer he wanted to take the weekend “to think about it.”
He said he wanted to remain anonymous, and need time to ponder how the case might be handled because he was after “civil restitution.”
The Tracy Police Department received 502 calls for service between Friday and Sunday. The following is a sample of those calls.
Sunday (169 calls):
2:06 a.m.: Police arrested a 22-year-old man on suspicion of drunken driving at Acacia and East streets.
2:58 a.m.: Police questioned two people at Bessie and Lowell avenues who were suspected of having gang ties.
8:14 a.m.: A caller reported people drove onto grass in front of the Orchard Estates Mobile Home Park, 812 W. Clover Road, hopped out and started to beat a dog with sticks. A second caller said they were there to “subdue” a pit bull that had killed another dog. Police said one dog was taken to a veterinarian.
10:37 a.m.: A man reported someone broke a car window on the 200 block of Tassajera Court. The caller said the suspect might be a guy who keeps calling his girlfriend, and police were asked to talk to the guy and tell him to stop calling.
10:57 a.m.: Police questioned someone at the 99 Cents Only Store, 1320 W. 11th St., who was suspected of having gang ties.
11:51 a.m.: A caller reported “mom’s” home was burglarized at Trail 50, 650 E. 11th St.
11:58 a.m.: A woman on the 200 block of West Lowell Avenue reported a guy in a red shirt tried to fight one of her neighbors. She said guys walked up to other tenants, asked if one “banged,” and when the answer was, “no,” walked off.
12:06 p.m.: A caller reported her daughter’s “ex-boyfriend” has been making threats” and “now two of their tires have been slashed” on the 100 block of Willow Creek Drive.
12:23 p.m.: A caller reported a guy who was following the caller closely hopped out of his car and kicked the caller’s car door at Grant Line Road and Holly Drive.
2:15 p.m.: A woman reported a reckless driver followed her “all the way around the mall” at 3200 Naglee Road and flipped her off.
5:45 p.m.: A caller reported hearing four or five gunshots on the 100 block of East Ninth Street. A bartender told police suspects took off with a gun in a green Buick, and turned onto 11th Street. An officer found one shell casing on the ground, and an officer went to a home on F Street, where a man was arrested on a $20,000 outstanding warrant for petty theft.
6:03 p.m.: A caller reported a 16-to-18-year-old boy pulled a gun and pointed it at the caller on the 100 block of West 23rd Street. The caller said the guy said nothing, but “just cocked the gun and ran off.”
7:57 p.m.: Police arrested, cited and released a 44-year-old man after a woman reported her husband might have been drinking prior to a scheduled child exchange at Save Mart, 2005 N. Tracy Blvd. She said didn’t want her child in his car.
9:53 p.m.: Police arrested on suspicion of harassing someone, cited him and released a boy to his mother on the 100 block of East Ninth Street. Police suspected the boy might be tied to gangs.
10:09 p.m.: Police arrested a 21-year-old man at 10th and F streets suspected of having gang ties.
Saturday (193 calls):
12:12 a.m.: A delivery driver reported the theft of gas at Tracy Honda, 3450 Auto Plaza Way. The caller said fuel was all over the ground where gas was taken from several cars.
1:46 a.m.: Police arrested a 32-year-old woman and took a sample of her blood after she crashed her pickup into a tree at Tracy Boulevard and Mount Diablo Avenue. A tow truck hauled off a Ford F150.
3:30 a.m.: A caller from Denny’s, 3718 N. Tracy Blvd., reported three women and two men were drunk and being loud, but the caller eventually told police she’d call back if they needed to be escorted out.
7:33 a.m.: A caller reported a home was burglarized on the 1300 block of Barons Court, and the burglar might have gotten inside by breaking a kitchen window.
9:19 a.m.: A pregnant woman said her husband choked her on the 400 block of Montclair Lane, then took off in a white Ford Escort.
10:01 a.m.: A caller reported finding a hypodermic needle at Eaton and Parker avenues.
11:59 a.m.: A trailer was burglarized at Zatran Fine Foods, 3402 Mars Court, a caller reported.
12:05 p.m.: Police questioned three people on the 300 block of West 22nD Street who were suspected of having gang ties.
12:37 p.m.: A caller reported graffiti on a sound wall on the 2700 block of North Tracy Boulevard.
1:16 p.m.: A caller reported several kids smoking drugs on the 300 block of Jason Court. He told police they might hide their drugs in a field next to his house, and they took off before police arrived.
1:56 p.m.: A woman reported a man assaulted her at Gandy Dancer Drive and Tracy Boulevard. She said he was taking down her signs when he hit her, and she told police she was holding onto his bike “to keep him there.” Police questioned three people but made no arrests.
2:55 p.m.: A caller reported a hit-and-run at the Tarasco Market, 204 W. 11th St.
7:18 p.m.: Police arrested a 46-year-old man suspected of having gang ties on a drug charge at Ninth and B streets.
8:03 p.m.: A caller reported three kids were spray painting a house on the 3100 block of West Grant Line Road. Police questioned three people, and cited and released one suspect on suspicion of carrying a knife.
9:18 p.m.: Police questioned two people at Holly Drive and Carlton Way who were suspected of having gang ties.
9:22 p.m.: Police arrested a 50-year-old man on suspicion of drunken driving at 23rd Street and Parker Avenue.
11:34 p.m.: A woman reported that she hit and killed a yellow Labrador retriever at the West Valley Bowl at East and Sixth streets.
11:26 p.m.: A man reported someone driving a blue Chevy truck ran into his 1998 Honda Accord while it was parked at Bettencourt Way and Fairmont Lane.
Friday (141 calls):
2:24 a.m.: A woman reported there were teenagers at her front door on the 600 block of School Street and she had no clue what there were doing there. They were gone when police arrived 18 minutes later.
7:48 a.m.: A caller reported graffiti was “spray painted all around the park” at Thoming Park, 1000 Cambridge Place.
8:34 a.m.: A woman on the 500 block of Pombo Square Drive reported her “ex-boyfriend” got in her purse and stole the keys to her rental car in the night, then drove off with the silver 2009 Mazda.
8:53 a.m.: A caller from the Prime Outlets, 1005 Pescadero Ave., reported someone has been “throwing away medical waste in their garbage,” and the caller had the name of a suspect.
9:11 a.m.: Police arrested, cited and released an 18-year-old man on suspicion of drug violations at West High School, 1775 W. Lowell Ave.
10:07 a.m.: Police arrested a 20-year-old man suspected of having gang ties after a caller on the 800 block of Sultana Drive being in a fight with her son. She said the argument started over the phone when she told her son he couldn’t bring his girlfriend over. She said he showed up, vandalized the home and hit her. She told police he sometimes carries a knife and in the past has threatened to kill her.
11:23 a.m.: A caller complained people keep spending the night in a boarded-up home on the 3200 block of Jeanette Court.
11:42 a.m.: Police went to West High School, 1775 W. Lowell Ave., where they talked to a 17-year-old boy suspected of having gang ties.
1:07 p.m.: Police went to West High School, 1775 W. Lowell Ave., on a report of drug violations.
3:29 p.m.: Security guards ran down a boy they said tried to steal alcohol from Rite Aid, 1970 W. Grant Line Road. Police arrested, cited and released the boy to his parents.
3:39 p.m.: A caller from Kimball High School, 3200 Jaguar Run, reported that a 14-year-old boy was being detained in the office for threatening a teacher. An officer showed up, but administrators said they wanted to handle it “internally.”
4:23 p.m.: A caller reported “gang graffiti” on tables at Costa Park, 1441 Claremont Drive, and that two “gang related” guys wearing bright red clothing were playing loud music. Police questioned three guys.
5:20 p.m.: Front glass was broken out of the offices of the San Joaquin County District Attorney’s office, 85 E. 10th St.
5:44 p.m.: A hit-and-run crash was reported in the parking lot of West High School, 1775 W. Lowell Ave.
5:45 p.m.: A caller reported a drunken man was at Sunset Liquors, 2355 Parker Ave. An ambulance picked up the “severely intoxicated” man.
7:01 p.m.: A caller reported someone lit fireworks at De Bord Avenue and MacArthur Drive. A second caller said an M-80 exploded.
7:50 p.m.: Police questioned three boys at Tracy Boulevard and Vallerand Road who were suspected of having gang ties.
8:42 p.m.: Police searched a home on the 1400 block of Franklin Avenue and found a 49-year-old man on probation hiding in a closet in the attic.
9:12 p.m.: Police questioned two men at Save Mart, 2005 N. Tracy Blvd., who were suspected of having gang ties.
10:46 p.m.: Police arrested an 18-year-old man at Balboa Drive and Kavanagh Avenue suspected of having gang ties.

City of Tracy Municipal Code 5.08.350 defines specific actions a dog must commit to be declared either “Potentially Dangerous” or “Vicious”. Under the code, dogs which have attacked and injured/killed another dog may only be declared “Potentially Dangerous”. The code allows us to place specific restrictions on how they maintain the dog to prevent further incidents. There is no provision of the law which allows me to seize and euthanize a dog for a first time attack (on another animal). A dog declared “Potentially Dangerous” that attacks again, may declared “Vicious” and seized.
We declare dogs fairly often, this case will be odd as the dog does not live in city limits and therefore not generally held accountable to city code. The attack did occur in city limits so I should be able to put through some type of restrictions – I’m working with our city attorney to determine exactly what types.
We did pass the report on to the county animal control who handles the jurisdiction where the dog lives; however, the state law governing this topic (the ordinance they would utilize) states dogs may only be declared after two dog attacks, so I am not expecting much from them.
-Also having had several dogs in my life and the problem for that Pitbull as I see it is; it may have already and will continue to exude this aggressive behavior again and again, only maybe next time instead of an adult (your 73-year-old father is a brave man) a young child could be become accidently involved or some other person.
-File a police report, and contact animal control services.
-The Pitbull not only cost the life of your Scottish Terrior, Barney, but will loose it's own.

I'm sure many of you reading this have dealt with a neighbor who allows their dog to run free to take a dump on yours or someone's else's yard. As long as it's not their yard and they don't have to clean it up themselves they don't care, and it's a waste of time to ask and try to reason with such a ignorant person. However if their choice to allow their dog to run free and they get hit in the wallet with a citation or any bills caused by the damage their dog causes then and only then do they seem to care.
As of now all of us in my family have a hole in our heart. Losing Barney this way hurts so bad. Thanks to everyone for their kinds words and prayers.
First of all, I truly am sorry for the pain that you are going threw. It's very difficult when you lose an animal that is part of your family.
As for the owner of this dog, he is very irresponsible as you say in your words that he is incarcerated... and why does someone own a large dog in a trailer park? I hope that you don't think that all Pit Bulls are vicious and killers. Any loose dog is capable of doing this, and when dogs have irresponsible owners, tragedies like these happen. I will pray for you and your baby.
Please everyone don't allow your dogs to run free, please help avoid the grief my family and I are dealing with. We loved him so much and spoiled him with all our hearts. We're going to have him cremated so we can bring him back home. Please pray for our baby.
