A preliminary hearing is set for the three men charged in the December shooting of Tracy resident Spencer Sampson.

Roberto Arias Jr., 19, Martin Flores, 21, and Armondo Hernandez, 20, are due back in court March 4, when the judge will decide if there is enough evidence to go to trial. They face homicide and street terrorism charges, along with allegedly committing crimes to further a street gang.

Sampson was shot on Dec. 19, his birthday, as he walked down East Street with his sister and a friend. He died the next day. The district attorney has yet to decide whether they are going to seek the death penalty.

Attorney Gary Hickey represents Arias, Attorney Ralph Cingcon represents Flores, and Attorney Douglas Jacobson represents Hernandez.

The three still remain in San Joaquin County Jail without bail.
