A hearing for two men accused of the brutal August slaying a Tracy woman was continued today until Jan. 25, when a trail date could be set and a decision is expected on whether prosecutors will seek the death penalty.

Robert Morgan, 39, and Jorge Morgan, 24, stand accused homicide for the Aug. 6 killing Cynthia Ramos, 58, in the Green Oaks Mobile Home Estates on MacArthur Drive, where the defendants and the victim lived.

Each face special circumstances allegations of killing the woman during the commission of a robbery, and murdering her in the commission of a burglary.

The Morgans, registered domestic partners in San Joaquin County who have told the court they’re married, were in court briefly today for a hearing at which prosecutor Valli Israels told the court no decision has yet been made on whether District Attorney Jim Willett will seek the death penalty.

“We take it very seriously,” she said. “We will set it for trial when we know whether we’ll proceed with the death penalty.”

The autopsy report showed Ramos tried to fight off her attackers when she was stabbed 55 times, bludgeoned 13 times and strangled with a rope or twine. Ramos’ roommate, Mary Arafiles, told police she saw the Morgans leave the mobile home carrying Ramos’ locking suitcase, which she used as a safe for her jewelry and other valuables.

The two men will be back in court Jan. 25.

Normally I might argue aganst capital punishment and whatnot, but the paper keeps printing their faces. They don't look sorry. One looks like the husband and the other like the "wife". Too bad they didn't end up like Bonnie and Clyde. We must have way too many liberal judges and not enough jail cells.

I hear the DAs get laid off in bad economies when crime rates go up. The same thing happened in a fist full of dollars. Just now the liberal lawyers could stand to make money from the media delaying what looks like an open and shut case. Somebody must be getting something outta looking at them.

Media, Give us dirty laundry. Or at least a Java Script with a movable noose.

Indeed very lengthy and costly to prosecute a murder trial and I believe 4-out-the-5 homicides in ('2009) Tracy are attempting to seek the death penalty. (So far no one's been charged for that poor man on W. Carlton).

Then what?

You sit on death row for another 25-or-so years wading through the appeals process.

The system is collectively out-of-date, cost-ineffective, and an out-right travesty to the families of these victims.

Send 'em to hell and be quick about it.

Considering that she stabbed 55 times, bludgeoned 13 times then strangled, one would think that would definitely qualify for the death penalty. Do they really need anymore time to put any thought to it ?

And please everyone, warn you friends and don't make the same mistake I just made. When I came to this site I was eating, and to have those two mugs flash on the screen when you have a mouth full of food nearly caused me to need the Heimlich Maneuver.

I can tell from the pics that 24 year old Jorge played the woman and 39 year old Robert played the dude. Whatcha got here is an old dude scoring himsef a young,um,chick. So I figure Robert did the lion's share of the murder while Jorge sat back and did her nails squealing encouragement. It's all velly confusing.
