Huckaby trial set for Oct. 18

Judge Linda Lofthus today set Oct. 18 as the start of the trial of Melissa Huckaby, the woman who faces the death penalty on charges that she kidnapped, raped and killed 8-year-old Sandra Cantu last March.

One of Huckaby’s defense attorney’s, Michael Burt of San Francisco, said he has a federal death penalty trial in Hawaii earlier in 2010 and would unavailable for a trial here until the fall.

Meanwhile, prosecutor Tom Testa said he’d do everything he could to keep the trial in Stockton, though defense attorney can ask for a change of venue and try to have the trial moved to another county.

“My big goal is to keep it in this county,” Testa said.

Huckaby, 28, is scheduled to be back in court at 9 a.m. Feb. 16, when attorneys will discuss how much of the prosecution’s evidence has been shared with defense attorneys up to that point, and perhaps other issues.

Because it’s a death penalty case, Huckaby is entitled to have two attorneys. Public defender Sam Behar is Huckaby’s other attorney, but he was absent today because he has the flu.

Lofthus and the attorneys also agreed on an Oct. 27 court date so they can work out any issues that might arise to make sure the trial is not further delayed.

Sandra disappeared March 27 from the Orchard Estates Mobile Home Park on Clover Road, and her body was found in a suitcase April 6 in a dairy lagoon north of town.

Huckaby was arrested April 12, and has been in custody ever since.

I agree with what both DeltaJim & Nick2 stated! An eye for an eye... After found guilty they have time to fight this and or get out. What are we doing to our country by housing all these criminals. I use to live in Tracy, California and it is sad to see that there are more scools being closed down and more prisons being built. What is that telling US? We need to do what they did in the old west kill them all. You can't reform people after they did what they did. I feel very sadden to hear about Sandra Cantu but sweetie Melissa Huckabee will get in the end.

I understand & agree that the any defendant has the right to proper attorneys, but that shouldn't mean their attorney of choice no matter how booked in advance they are! Where are the rights of the victim? Doesn't she (or any vicim) have the right to get justice in a timely manner? There has to be more than a million lawyers in the world. If a person has the need & the right to counsel, they should have to hire one available for the job. 19 months from the crime to the trial is entirley unnecessary!

I agree DeltaJim, an eye for an eye. Whether it be a male or female.

What I don't like is after when they are found guilty of the murder, then they have 10 years more to fight to get out. They didn't give their victim that time to be with their family, so they shouldn't have that time either.

I dunno about that, if you asked me, I'd say what happened to little Sandra Cantu was an act of evil. Mental or not, Melissa Huckabee needs to pay for what she did to that little girl.

It's sad that people think differently about this crime because it involves a woman. If it was a man that committed this horrific crime, people would be saying, kill-em, kill-em, but it's a woman, so people are saying that she needs psycho help.

I believe in an eye for an eye, and this case should be no different. But even myself, I have said, "this woman needs psycho help." But what's the point? She should never see the gates to freedom ever again in her natural born life.

God Bless Sandra Cantu.........

Oh, and BTW, YES I AM HUMAN.

I agree. Where they're sending her, she will spend the rest of her days with other psychotics, sociopaths, serial killers and others. Kinda makes what I did last week look small. (I stole two pieces of pizza from the buffet line without paying for them.)

This is a sad case. I mean the total destruction of two lives. This case is'nt about good or evil. It's about psychology.
