Deborah Fialkowski, who represents Jessie Llorente III, 39, said this morning she hasn’t heard back from a psychiatrist who is conducting a court-ordered report on her client to determine the likelihood of Llorente becoming a repeat offender upon release.
Llorente had subbed for Kelly Elementary and pleaded no contest on Sept. 14 to nine felony counts of lewd acts upon a child, nine misdemeanor counts of child molestation and one felony count of possessing child pornography. Llorente will face up to three years in state prison and have to register for life as a sex offender.
Fialkowski told Stephenson today that she was unsure if the report has been filed and got an answering machine when she tried to call the doctor this morning.
Both Fialkowski and prosecutor Elton Grau were unsure of a timetable of when the doctor’s report might be completed.
Fialkowski said that the doctor conducting the report has gone on vacation and there were also some problems related to the court requesting the report, which Stephenson ordered at the Sept. 14 hearing.
Fialkowski and Grau will return to court at 1:30 p.m. on Dec. 1, where they will proceed with Llorente’s sentencing if the report is done.
Llorente was led into the Stockton courthouse at about 9:35 a.m. and talked with Fialkowski for a few minutes before his case was called. After Fialkowski explained the situation with the doctor’s report, Grau and Stephenson agreed to meet next week and Llorente was led back out.
Llorente is in custody on $1 million bail and was arrested by Tracy police on March 19. Police said at the time that Llorente became aroused while touching the hair and shoulder of eight girls he taught. When an officer went to the school to talk to him, police said in March, he admitted to owning child pornography.
