Meanwhile, a fundraiser has been organizer to help the family of the only person killed in the shooting, Naim Bey, 41, of Tracy.
In a court appearance that took only a few minutes, the defendants were told to show up at 9 a.m. Tuesday to continue their arraignment.
Michael Dwayne Mau, 24, of Tracy, faces 13 counts of homicide, street terrorism; Elvis Mendoza, 28, of Tracy, Johnny Joseph Martinez, of Tracy, 25, and Cecilia Naomi Colon, 21, face charges of street terrorism and being accessories after the fact. Prosecutors allege Mau, Mendoza and Martinez are gang members.
One issue that still has to be worked is who in the Public Defender’s Office will represent Mau.
Public defender Charles Henry was at Mau’s side at the hearing, but said afterward that his department has yet to decide who will represent Mau, though he expects a decision to be made so Mau’s new attorney can be on hand for Tuesday’s hearing.
Victoria Bossie is a private attorney who will act as a public defender to represent Martinez; Mendoza has hired private attorney Mark Thiel; and Kristine Eagle is a private attorney who was appointed to represent for free Colon.
The three men were arrested Saturday, about 12 hours after the 1 a.m. shooting earlier that day at Amore’s at 11th and A streets.
Amore’s every other Friday night had been converted into a nightclub that customers and its manager say usually drew family and friends.
Witnesses say Mau, Mendoza and Martinez got into a scuffle that night ask were asked to leave, which they did.
But prosecutors say Mau went outside, grabbed a gun and shot eight times randomly into the front door. The three men then took off, prosecutors allege, and one witness saw two people leave in a pickup and another run off after his car failed to start.
Colon was charged on Tuesday, though it’s unclear what prosecutors allege her role is. Deputy district attorney Tori Verber could not be reached for comment, nor could Tracy police investigators.
Bey, the head of security for the Hillsdale Mall in San Mateo who also has his own security firm, was hit in the back of the head while standing near the bar.
Bey died two days later, and leaves behind a wife and two children. David Ernst, a friend of his through a car club, has organized a car wash fundraiser to ease the financial burden on Bey’s family. The fundraiser is scheduled for 9 a.m. to 4 p.m. Saturday at Kragens, 1210 N. Tracy Blvd., Ernst said.
Six others were shot as well, but they were treated and release from local hospitals.
The four suspects remain in jail. Bail for Mau was set at $2.5 million, and at $300,000 for each of the others.
