William Tipton, 31, and his wife Frayba Tipton, 35, will be back in court in Nov. 19 so their attorneys can discuss the evidence against their clients.
William Tipton’s attorney, Kirk McAllister, and his wife’s attorney Timothy Rein said they’ve so far received little of the evidence that prosecutors must share with them.
The couple has been charged with burning down their $1.2 million Fabin Drive home in a scheme to collect insurance money. Several firefighters got out of the home about 30 seconds before the roof collapsed, according to Division Chief Germaine Friends.
William Titpon has also been charged with grand theft.
Prosecutor J.C. Weydert today tried to get the Tiptons to tell the court where they are now living, claiming they’ve dodge process servers and are making no payments on four cars they own.
Weydert said if the couple refuses to make payments or give the cars back to the finance company that owns them, they could be charged with auto theft.
But Rein objected, and Judge James Cadle said the couple has shown up in court on their own and there was no good reason for them to declare their address.
Frabya Tipton owned A+ Realty and Mortgage, while her husband used to own West Coast Realty and Mortgage. William Tipton was booked in county jail late this summer on $300,000 bail, but was released due to jail overcrowding.
