UPDATE: Torture suspects to challenge indictment

STOCKTON — Four people plan to fight an indictment that accuses them of brutally torturing a 16-year-old boy and imprisoning him for more than a year inside a Tracy home.

Michael Schumacher, his wife Kelly Lau, their houseguest Carén Ramirez and their neighbor Anthony Waiters appeared in court today before San Joaquin County Superior Court Judge Terrence Van Oss, who gave their lawyers until mid-August to file the motions challenging the indictment on grounds of insufficient evidence.

Schumacher today pleaded not guilty to charges that he had a hand in torturing the boy called Kyle Ramirez in court papers. The three other defendants already pleaded not guilty a month ago at their last hearing.

The court on Friday unsealed nearly 1,000 pages from the grand jury hearing that led to the 17-count indictment handed down on March 23.

Prosecutors accuse the four of burning, bludgeoning, choking, shackling and starving the boy, who escaped in December from the Tennis Lane home.

Kyle told jurors in March that the defendants would chain him to a fireplace and would beat him for forgetting to feed the dog or for not taking care of Lau and Schumacher’s young children.

He said he finally got a hold of the key to the chain that tethered him, and unlocked himself on the day of his escape. He said the four openly plotted to kill him, so he felt he had to get away as soon as possible, according to grand jury transcripts.

Kyle rushed into the backyard, used a trampoline to vault over the wall into an adjacent parking lot and frantically ran into the foyer of a nearby health club. Witnesses said he was covered in soot and blood. He wore only a pair of boxer shorts and had some “goopy” stuff in his haphazardly shaved hair.

Police arrested Schumacher, Lau and Ramirez the week of Kyle’s escape. Waiters was arrested a week later. The four have appeared in court several times since their December arrest. They’re due back in Dept. 21 in Stockton on Aug. 21 at 8:30 a.m. for their attorneys to present oral arguments against the indictment.

Well,in a case like this a defense attorney would try to place blame elsewhere. Same as the standard pedophile defense. Turn the perp into a victim in the jury's eyes. Here's how it works. Pedo gets busted,consults with his attorney. Attorney asks pedo if he was molested as a kid Pedo says "Nope,did'nt happen". Lawyer responds "Gee,that's too bad. If you had been molested then I could portray you as a victim,have the jury shedding tears for you. Was'nt your fault you grew up to become a pedophile. You were trained to do this as a child. You'd be sent to Atascadero rather than sharing a cell in prison with Bubba". The perp thinks for mebbe ten seconds,yells "I just remembered. Yes,I was molested. Oh it was horrible. I'm a victim". That's how the system works,folks.

Gee, I really hope that the PD checked it out and it doesn't happen. SCARY!

Anyway, the Tennis Lane Quads will pay their dues. I really think there is no way they can get away with it. I really don't. From what has been reported, if it is correct, they'll do some time.

Tinfoil, I pray they will not get away with any kind of insanity plea! I can not believe that they would be able to get away with that.

I am inclined to go along with CN's idea....What about an island? Something small and isolated. They could all be together until the very end.

What I'm saying is the only route the four adults have available to them is to claim religious insanity. Just like the mothers we keep reading about in the news who murder their children so they'll be with Jesus. The choice facing the four adults is incarceration in the psycho ward for a short time or sharing a prison cell with Bubba for decades. Me,I'd take the nuthouse. I'd be fed well,get freebies up the yin yang and be able to con the stupid social workers.

For all of those reasons I don't comprehend how they could plead not guilty. I don't comprehend how four people could do to Kyle what was done, though. The whole situation dumfounds me. One abusive person working alone is believeable. Four people?!!!

Along with Kyle's word and that of the other children, there is plenty of physical evidence.... shackle marks on ankle, burn and cut marks on Kyle, the fact that he was malnourished along with the 3 year old.... plenty of physical evidence.

It is not his word against theirs. They also got statements from their children whose story matches Kyles.

Oh! jsmitty! Tinfoil does not live in Tracy. Most people in Tracy have teeth...not all of us, though.

On the subject...I don't understand the not guilty plea. I do understand that it is Kyle's word against their's, but his injuries would speak for him. Nobody ever said these four are sane, though.

Were I them I'd try to skate the charges by claiming a religious defense. I'd claim I went gonzo on Hooterville religion,appraised the kid as Spawn of Satan then proceeded to try to save his soul from the debble via the hard way. Think of the OJ jury. All you need is one religious freak on the jury. Had me been accused I would not say I did'nt do it. That won't fly. I'd say I did do it but it was for the kid's own good to save him from spending eternity in Hades. Oh I would WUV to pick the jury pool. I'd ask "How do you feel about Dr Tiller's murder?". Anyone responding "I think it's the cat's meow" I'd say baby you're on the jury.
