MANTECA — The preliminary hearing for three Tracy residents changed with dog fighting was delayed to early November during a hearing in the Manteca branch of San Joaquin County Superior Court on Friday, Oct. 18.
Kenneth Baldwin, 35, Gracie Baldwin, 36, and Luther Brewer, 49, face charges of aiding, permitting and training a fighting dog.
Kenneth Baldwin and Gracie Baldwin, husband and wife, face additional charges of being present at dogfights, cultivating marijuana and possession of hash oil.
Gracie Baldwin is also charged with being a felon in possession of ammunition, and Brewer is charged with being a felon in possession of a firearm and ammunition.
At Friday’s hearing, Judge Ron Northup approved a motion by the San Joaquin County District Attorney’s Office to continue the preliminary hearing to 8:30 a.m. Nov. 8 in the Manteca courthouse.
Two of the defense attorneys agreed to waive time for the new court date, but Jessie Garcia, Brewer’s attorney, withdrew his agreement.
After the hearing, Garcia said he didn’t want to waive time because “justice delayed is justice denied.”
Garcia said he had been ready to proceed with the preliminary hearing since “day one” of the case.
The deputy district attorney prosecuting the case was changed from Robert Baysinger to Ron Indran after the two attorneys exchanged jurisdictions between Stockton and Manteca.
Indran was not at the hearing and was unavailable for comment on Friday, Oct. 18.
The three defendants are accused of supporting a large dog fighting operation that was raided March 31 by several law enforcement agencies in Benton County, Miss.
Kenneth Baldwin allegedly escaped that raid, which led investigators to Tracy.
The Baldwins and Brewer were arrested April 3 as representatives of the sheriff’s departments of Sacramento and Placer counties and the Humane Society of the United States raided two houses in Tracy.
During the search of the houses — at 2386 Lighthouse Circle and 2105 Elsie Way — officers seized 14 pit bulls allegedly used for fighting and more than 26 pounds of marijuana.
