Dog fighting charges dropped

MANTECA — Charges of dog fighting filed against three Tracy residents were dropped by the San Joaquin County District Attorney’s office during a court hearing on Wednesday, April 24.

Kenneth Baldwin, 35, Gracie Baldwin, 36, and Luther Brewer, 49, were charged with aiding, permitting and training a fighting dog.

At the start of a preliminary hearing for the co-defendants in San Joaquin County Superior Court, Deputy District Attorney Robert Baysinger told Judge Ron Northup that he was not ready to proceed.

The three defense attorneys, however, told the court they were ready to proceed and that none of their clients were willing to waive time.

Preliminary hearings must be held within 10 business days from the last hearing — which was on April 10 — if a defendant doesn’t waive time.

Due to the time constraints, Baysinger dropped all of the charges. He told the court he would re-file the charges on Friday, April 26, and a new hearing was set for 1:30 p.m. that day.

The three defendants are accused of aiding a large dog fighting operation that was raided by several law enforcement agencies in Benton County, Mississippi, on March 31. Kenneth Baldwin was allegedly able to escape that raid, which led investigators to Tracy.

They were all arrested on April 3 when the sheriff’s departments of Sacramento and Placer counties, and the Humane Society of the United States, raided two homes in Tracy.

During the search of the homes — located at 2386 Lighthouse Circle and 2105 Elsie Way — officers allegedly seized 14 pit bulls that are believed to be used for fighting and more than 26 pounds of marijuana.

The Baldwins — who are married — should be released from San Joaquin County Jail in French Camp on Wednesday, where they’ve been held on bails of $500,000 and $130,000 since their arrests.

Brewer has been free on $300,000 bail, which was rescinded by the court on Wednesday.

After the hearing, Gus Barrera II, who is representing Gracie Baldwin, said he expects Baysinger to re-file charges, and will be ready to negotiate any new bail amount for his client.

Kenneth Baldwin had retained attorney Armando Villapudua for representation.

Deborah Baldwin, Kenneth’s mother, said after court on Wednesday that all of the puppies seized by police have since been adopted, but she plans to try and get her son’s older dogs back from authorities.

No information was available on the two dogs seized at Brewer’s house.

Hello. I am a dog lover as most friends of mine would know and, dogs are mans best friend and a woman's to. I hope the District Attorney reads this and hears my plea to follow through with charging theses despicable people again, don't fail our society here in town by letting them walk away and sending a message that animal abuse is not important enough to get your charges ready.

Prosecute these miserable animal killers to the fullest extent of the law.

Please get it right this time.

They have 2 small children...where did they end up? Parents like this have no right to raise children. I hope they are ashamed and care about how this will effect their children.
