MANTECA — A judge ordered the release Tuesday, Oct. 16, of a Tracy man who was arrested Saturday, Oct. 14, as he was allegedly driving his friend to a hospital for a gunshot wound.

Daniel Garcia, 19, appeared for the first time in the Manteca branch of San Joaquin County Superior Court since his arrest.

He was arraigned on two felony charges of possession of a controlled substance with intent to sell and transportation of a controlled substance, as well as several misdemeanor charges that include fleeing police, failing to stop at a traffic light and failing to obey a stop sign.

Tracy police responded to a party at 3205 Mars Court on Saturday at about 11 p.m., where a fight had allegedly occurred between two groups of males.

According to police, a sergeant responding to the call saw a four-door white Ford sedan leave the area of Mars Court and drive north on Tracy Boulevard.

The driver, later identified as Garcia, allegedly failed to stop and led officers on a short chase before stopping on Tracy Boulevard about 50 yards north of the intersection with Schulte Road.

During the traffic stop, police found inside the car a 17-year-old boy who had one gunshot to the back of his right shoulder. Garcia allegedly told police that he was driving the victim to a hospital, according to Tracy police.

The injury was not life threatening and the boy has been released from the hospital, according to police. The name of the boy is not being released, because he is a minor.

Garcia was arrested and booked into San Joaquin County Jail in French Camp.

However, on Tuesday, Judge Ron A. Northup ordered that he be released for the duration of his case.

Northup stipulated that Garcia, who told the court he has lived in Tracy for about five years, cannot be in the presence of any drugs or alcohol and can drive a vehicle only with a valid license as conditions of his release.

Any violations will result in the revocation of his $200,787 bail, which was set after his arrest Saturday.

The judge also appointed a public defender to represent Garcia after the teenager indicated that he was working but could not afford representation.

Garcia is scheduled to appear in the Manteca courthouse at 8:30 a.m. Nov. 5 for a preliminary hearing.
