Tracy trio pleads not guilty to dog fighting

MANTECA — Three Tracy residents accused of participating in dog fighting, plead not guilty to their charges in San Joaquin County Superior Court, but were denied a reduction in bail on Wednesday, April 10.

Kenneth Baldwin, 35, Gracie Baldwin, 36, and Luther Brewer, 49, are charged with aiding, permitting and training a fighting dog.

Kenneth Baldwin and Gracie Baldwin, husband and wife, face additional charges of being present at dogfights, cultivating marijuana and possession of hash oil.

Gracie Baldwin is also charged with being a felon in possession of ammunition, while Brewer faces additional charges of being a felon allegedly in possession of a firearm and ammunition.

The three are accused of aiding a large dog fighting operation that was raided by several law enforcement agencies in Benton County, Mississippi, on March 31. Kenneth Baldwin was allegedly able to escape that raid, which led investigators to Tracy.

They were all arrested on April 3 when the sheriff’s departments of Sacramento and Placer counties, and the Humane Society of the United States, raided two homes in Tracy.

The Baldwins were arrested at 2386 Lighthouse Circle, and Brewer at 2105 Elsie Way.

During the search of the homes, officers seized 14 pit bulls that are believed to be used for fighting, according to police.

Judge Ron Northup denied separate requests by the defendants’ three attorneys for a reduction in their bails.

The defendants’ charges require the judge under California Penal Code 1275 to take into consideration public safety, prior convictions and the seriousness of the offense when altering bail amounts.

Attorney Jesse Garcia, who was hired to represent Brewer, asked the court to reduce his client’s bail from $300,000 to $100,000.

Garcia believed that the eight ounces of marijuana allegedly seized at his client’s home was being unfairly added to the 26 pounds allegedly seized at the Baldwins' house.

Jay Alan Childs, court-appointed attorney for Gracie Baldwin, said she had only one criminal conviction in 2001, and asked for a bail of $90,000.

Public Defender Berthier “Butch” Maciel, who represents Kenneth Baldwin, said his client has criminal convictions from the 1990s and 2003.

Judge James Cadle had reduced the Baldwins original bail on April 5 from $1.4 million, but left Brewer’s the same because a reduction wasn’t requested by his attorney.

Northup set a preliminary hearing for 8:30 a.m. on April 24 at the Manteca branch.

Tried locating in the Press any articles about Home Goods Store coming to Tracy to be located where the old Staples store was. Does anyone know about this?

Let me get this straight, the couple have home in Hidden lake? They are appointed a public defender? Had 14 pit bulls at their home in Hidden Lake? Had 26 pounds of marijuana? Have been convicted of prior felonies and also had guns and ammunition? Real great people living there.

Were they renting at Hidden Lake or homeowners? Appointed public defenders?

Animal cruelty is down there in the gutter where they belong. I hope the jury is full of dog lovers.

If they were buying the house at Hidden Lake would you think they may have to sell it? They'll have new homes anyway, in prison.

These are the type of evil people who pray on innocent animals, these devils use other animals as bait for their sick twisted pleasures and capitol gain. The evil cowards here enjoy hearing animals cry out and watch them go into shock from fear or loss of blood. I hope these three evil cowards get their dues in prison and never see another free day in their life. I hope I never see any of them around animals, ever!

Pffft. And I thought my neighborhood was going downhill. Imagine investing all that money in Hidden Lake and Redbridge and seeing those neighborhoods going downhill.

AS a pitbull lover and have owned several throughout my years this breaks my heart. People like this just disgust me and i will not ever understand the hate in these type of people to do this. I know what and how they train the fighting dogs and its too graphic to even state it here. (they deleted my comment last time on what they do) "heartless!" demons and devils are what comes to my mind when i look at thier pictures.

As a pitbull owner I feel the same - extremely disgusted that this is happening in my own neighborhood.. my first reaction is to do unto them as they have done to these dogs! These people are the kind that give these dogs a bad name. How can you be so heartless to do this to these beautiful animals that are already misrepresented by the media.. I hope you people are exploited beyond your worst nighmares!

SO glad the authorities finally caught these "people"! We walk the lake often and the stench from their yard of marijuana and dog feces was overwhelming! The howl of the dogs and the aggressive way they would attack the fence anytime someone would walk by made it obvious something was going on. Thank you, Judge, for holding firm and not reducing their bail. And yes, I am sure animal abusers are not taken lightly in prison. Good. They aren't taken lightly out here either.

@justmembj it's funny how am hearing that hidden lake is really strict on how many dogs are allowed in your cul-de-sac. Your now on this site acting as a concerned citizen our neighbor. But as you posted in your comment when you walked by the house you could smell the marijuana and the way the dogs attack the fence when you walked by you could tell something was wrong but yet you didn't call the police or contact the HOA so to me your full of Crap. I have passed that home when a party was going on and I don't hear any dogs barking.

The last I check your innocent until proven guilty not guilty until proven innocent.

I don't know anything about the HOA or their rules. The City of Tracy has an ordinance limiting the number of dogs and cats you can keep at a residence that applies to everyone within city limits.

Well.. Brewer looks middle age and Baldwin's will be(minus the pit bull look) in another 5-10 years: "What are ya in fer?" "Oh... dog fighting..." Inmate: Get the "f" outta here...

a vanguard in the community gets arrested for molestation his mantra is to challenge the pros. DA, that "he's just some guy" in a system of jurist prudence that favors liberal judges. So what happened to your friend Dave..?
