Stockton man takes plea deal in 2012 Tracy murder

STOCKTON – A Stockton man agreed to a 39-year prison sentence after admitting he shot to death 23-year-old Jose Anthony Sosa Jr. of Tracy in February 2012.

Manuel Jiminez Pelayo agreed to the plea bargain during a hearing in the San Joaquin County Superior Court on Monday, Jan. 27.

Pelayo, 21, of Stockton entered a plea of guilty to the charges of attempted murder, personal discharge of a firearm, street terrorism and admission to being a gang member. As part of the deal, Pelayo agreed to a 39 years prison term.

Co-defendant Samuel Inguanzo, 20, also of Stockton, also plead guilty during the Monday hearing. According to Deputy District Attorney Tori Verber, Inguanzo admitted he was driving the car Pelayo was riding in at the time of the shooting. Inguanzo agreed to a 16 year prison term for the charges of voluntary manslaughter and admission to being a gang member.

Judge Hoyt informed Pelayo and Inguanzo that their admission of guilt was for violent and serious felonies that would result in both getting two strikes each on their criminal records.

The Judge said they would be required to serve 85 percent of their sentences, and split the cost of $7,162 restitution to Sosa’s family.

Upon their prison release, Hoyt said both men would have to register as gang participants for five years, and serve four years on parole.

Pelayo and Inguanzo told Hoyt that they agreed to the terms of their sentence. Both are due back in Stockton court at 9 a.m. on Feb. 24 in Department 21 for formal sentencing.

Sosa was shot to death at the corner of Eleventh and Walnut streets as he walked home from a local bar around 1 a.m. on Feb. 4, 2012.

According to family members, Sosa left a wife and a four-month-old baby at the time of his killing.

Verber, who met with members of Sosa’s family following the hearing, said family members plan to address the court during the formal sentencing hearing.

Pelayo and Inguanzo will await their sentencing in custody at San Joaquin County Jail in French Camp.
