An 18-year-old man from San Jose was badly injured when he was struck by a pickup while crossing Tracy Boulevard at 2:24 p.m. Friday, July 27.
Lt. Wade Harper said the injured man was with two other men as they crossed the northbound lanes of Tracy Boulevard near Loma Verde Drive south of Schulte Road. He said the man was hit by a Chevrolet S10 pickup and sustained a lacerated spleen, a fractured bone in his lower body and abrasions, according to Harper.
He was flown by helicopter to Kaiser hospital in Sacramento.
The man’s was in intensive care as of 6 p.m. Friday, and no information was provided by police regarding the driver of the pickup.
A couple who witnessed the accident while traveling south on Tracy Boulevard described the scene as horrific.
Declining to provide their names, the husband said he saw the three men crossing to the median of the boulevard. His wife said she even slowed down for fear they were going to walk into her path on the southbound side of the divided roadway.
“They were crossing super slow,” said the husband, watching the crash from the front-passenger seat of the car. “One guy stepped back or lost his balance (off the median). He hit the truck — launched into the air 50 feet. It was pretty horrific.”
The husband said he ran up to the injured man with the two men who accompanied the 18-year-old. The husband said the teenager was lying motionless in the roadway.
“My first impression was that he was already dead,” said the husband. “I was shocked when I saw him breathing. He was moaning and trying to get up. I told them my wife called 911.”
Police closed the southbound lanes of Tracy Boulevard between Central Avenue and Schulte Road until shortly after 6 p.m. Friday while traffic officers conducted their investigation.
I live off Tracy Blvd/Schulte and have crossed (yes in the crosswalk) many times...and still have to run for my life to make it across. People do not drive the speed limit and they do not give pedestrians the right of way.
I agree many kids walk too slow across the street-while jay walking and even when using cross walks. It is a major concern of mine since I have a teenager myself. They do act like idiots when they are with friends. Why is walking slow "cool"?? I am hoping to share this as another example of how dangerous crossing a busy street (or any street) can be. This part of Tracy Blvd. seems especially dangerous, there have been far too many accidents. Hopefully, everyone can be more aware and cautious and courteous to one another.
It might also be argued his friends didn't either in that they crossed between two intersections an one did not have a traffic control signal, if ya want ta take a narrow view of th law.
But th VC also states that within a municipality that municipality has th authority ta define what is an what is not considered ta be jaywalkin.
In that vein I recomment City Council adopt a local law sayin that on any street that is non-residential or whair th posted speed limit fer vehicular traffic exceeds 25 MPH that it is illegal fer pedestrian to cross the road anywhair thair is not a pedestrian crosswalk regardless if traffic control signals exist or not.
It's unfair ta make motorists guess an stupid ta thank that pedestrians are gonna automatically know whair they can safely cross or not.
So whair th CA VC stupidly doesn't adequately define it it at lest does allow th local municipality ta correct that stupidity.
Th pedestrian that stupidly claim's "I am right" isn't gonna be able ta make that statement if he or she is dead.
How much will it cost to paint crosswalks for the entire city, and make a new ordinance (that won't be enforced), because a kid lost his balance and was hit by a vehicle?
Excellent knee jerk reaction, oh wait let me say it so you understand.
Th fer ta wher stupidly.
At times I believe ya ta be delusional.
Whair did I indicate that crosswalks should or even could be painted all over th city?
Agree we have too many laws on th books. What I'm talkin about here is correctin a poorly written law in th VC through local ordinance ta take th ambiguity out of th law.
Th cops can arrest em but as soon as it hits th courts they know they can get off. Th reason is th ambiguity in th VC.
Already thair ar several cases before th court, which cost us, th taxpayer money, whair scofflaws have either caused accidents by thair jaywalkin or have gotten hit an caused other damages whair thair court appointed attorneys, (who pays fer them in th long run?) usin th rather foolish definitions of what contitutes jaywalkin under th VC an are or have gotten thair clients off.
Yes, 1 ta 110 year-olds are gonna do stupid thangs an make poor decisions. We all do.
But it's rather foolish ta expect yer police ta attempt ta crack down in th pursuit of public safety when th revolvin door of a poorly written law lets em go an th only thang accomplished was ta raise th overall bill ta th taxpayer.
People are gonna speed regardless of th law, da ya propose we simply abandon all efforts ta control speed on our highways an thoroughfares?
I don't thank ya would.
Was that ANOTHER personal attack on me? "delusional"?
You want make a law saying you can't cross the street anywhere but in a crosswalk, in non residential areas where the speed limit is over 25mph.
The city would have to put in many more marked crosswalks to facilitate crossing the street just for the kids to get to and from school.
And if the city made it an ordinance then the ticket would go to the city attorney, not the DA. and there is no right to council or jury trial for an infraction. But we would have to hire more city employees to cover the workload of processing all of the extra citations and hearings that your new law would generate.
Ornley you should be a politician cause you are making government bigger for no apparent reason. Or are you already in government?
But way to put no thought into the problem before spouting off.
Spoilin fer a fight aren't ya? Well frankly I don't have th time or th inclination as it would be akin ta fightin an unarmed man.
Ya got a strange notion of rules, ordinances an such but that's yer rignt.
Instead of bein a part of th problem I suggest ya attempt in bein a part of th solution.
All I have seen here, frum ya an others here are complaints an not any suggestions on how ta make thangs better. That makes ya a part of th problem if nothin else does.
Ya got some ideas? Bring em out. But if ya got nothin more than complaints yer wastin yer breath an while some might agree with ya yer not gonna make anything better so ya might as well stop wastin yer time.
As poor as th VC is it does offer communities a chance ta make effective changes. Or ya can just continue ta carp about how bad th police are doin thair jobs an not give em th effective tools ta really do thair jobs effectively.
Th reason ya have jaywalkers, especially in our young people taday, is that while people know it's a bad idea an against th law, they don't care.
It's not gonna effect them an they know better. That is until they get bug splattered on someone's fender or windshield.
Have yerself a nice day an be glad ya still have a life ta live. That alone is somethang ta be thankful about even if it's filled with otherthangs that are painful.
Unless th driver has other mental problems hittin this kid, right or wrong, is gonna leave some mental scars. Not ta mention, who's gonna pay fer th physical damages ta both th kid that got hit an th driver of th vehicle?
Insurance? Th state? Who? Any way ya look at it th whole stupidity has a cost ta th entire public when it all could have been avoided in th first place.
Feel bad about th kid's injuries. Feel bad fer th driver too even though no one apparently does or not many at best.
Jaywalking
What exactly is jaywalking? What is the monetary fine for jaywalking?
Origin of the word: Jaywalking is a compound word. "Jay" refers to a foolish rural person who is unfamiliar with city ways.
Technically, jaywalking refers to a pedestrian who violates traffic regulations, particularly when crossing a street or road.
Under California state law, a pedestrian may generally cross a roadway anywhere along the road without jaywalking. But there are exceptions. Here are the main exceptions:
Exception #1:
Classic Jaywalking: If you are between two adjacent intersections that are both controlled by "traffic control signal devices" (i.e. a traffic light), then you, the pedestrian, must cross at the intersection. See California Vehicle Code §21955.
Issue: What if a person walks only part way across the street? What is he or she does not completely cross the street? Does this jaywalking statut
You are, again, asking the wrong questions. Perhaps we ought to consider the judgment of the pedestrians, regardless of the issue of jaywalking.
Did they use good judgment while crossing the street? Tell you what, every day, when I elect to drive, I witness the poor judgment of young people crossing streets, and many of them do so with this "entitlement" attitude. Now, I don't know what happened here, so I posit no further comment.
Note shelly13, he had ta cross a section of road ta get ta th median. Splittin hairs that he tripped off th median, fer what ever reason, doesn't negate th fact he had ta have crossed th road ta get thair. An if thair was a crosswalk not that far away, why didn't he an his friends use it?
Under th strict defination of ConcernedTracyResident's understandin of jaywalkin an whair th word came from, it was a poor decision on th part of ta person hit that initially was th root cause of th accident.
Yep, parhaps th driver should have been more attentive but if th kid/kids hadn't exercised poor judgement th accident would never have occured.
Police don't enforce jaywalkin laws because there are no teeth in th current laws an it's just throwin away more taxpayer money fer them ta attempt ta do so under th present condition of th laws. An, while they may be foolish young people, our kids are smart enough ta know this so they jaywalk knowin that nothin bad is gonna happen ta em if they get caught. Nothin that is until we see an accident such as this.
A change in th municipal code in Tracy wouldn't cost much money, save a lot of taxpayer money an hopefully save at least one life. Ta me th nominal amount of money spent ta change our municipal code an give our police th legal tool ta start ta combat jaywalkin, even if it only saves one life, or th damage ta one life as in this case, would be worth th cost.
No, I am not in favor of more laws but th laws we currently have need ta be correct Or we shouldn't have em. Th current laws consarnin jaywalkin are not correct. It's really that simple.
Ya all want yer police ta do this an that but why won't ya give em th correct tools ta do it?
I saw the commotion with the medivac and was very worried about both the driver and the j-walker. Hey I have to say Im not perfect and I j-walk a time or two. Not very smart of any of us to do that..case in point.
PS I use my minivan to shuttle my kids to baseball, not soccer. Sounds like you are doing a lot of judging yourself. Calm down and take a long look in the mirror. This incident is a good use for everyone to be more careful and obey the law. Cross in a crosswalk!
My thoughts and prayers go out to the true innocent victim of this accident, the person driving the truck who hit the young man, and the young man's family who is forced to suffer through this situation.
"What was an 18 year old from San Jose doing crossing Tracy Blvd in Tracy?
Maybe he was visiting relatives, maybe he was here to see friends, maybe he was a gangbanger here on business.
Anyway you look at it, he had no business "J-walking" which is the term used for crossing outside of the crosswalk. By the way, "J-walking" is a misdemeanor so he was breaking the law.
I wonder if his pants were down around his thighs and that caused him to slip and fall in front of the vehicle?
Now he has no choice BUT to walk super slow. Lol!
Btw- on a serious note... Glad to hear he survived and I hope the driver won't be charged.
I will not make reckless conjectures about this pedestrian, but I have many times witnessed a young person wearing a cap with its bill off to the side, as if he were a clown, talking on the phone and holding his pants up while crossing the street, not looking up to see whether he was safe in the crosswalk.
This sight wasn't an exception.
The super slow thing caught my attention to. That just annoys the crap out of me when someone walks really slow while crossing the street. I am not talking about the disabled or elderly, that is perfectly understandable. Plus its not usually them that do it, its the teens and twenty somethings. They walk like they are dragging a 1000 lb boulder behind them or like perhaps they are intentionally crossing the street as slow as possible to piss everyone off. I dont get it. When I cross the street I want to get the heck out of the way as quick as possible to minimize the risk of getting hit.
