Father gets custody of Melissa Huckaby's daughter

The ex-husband of Melissa Huckaby — the suspected killer of 8-year-old Tracy girl Sandra Cantu — was on Monday granted sole custody of the couple’s daughter, court records show.

Johnny Huckaby reached a settlement with his former mother-in-law, Judy Lawless, which allows her to visit 5-year-old Madison Huckaby as long as the little girl has no contact with her mother, according to papers filed in Orange County Superior Court.

Melissa Huckaby has been held in solitary confinement in the San Joaquin County Jail since her April 10 arrest. Johnny Huckaby lives in Arkansas and Lawlesses in the Southern California city of Cypress.

A hearing brief filed Monday by Johnny Huckaby’s attorney says Madison has been “flourishing” under her father’s care. The couple married in 2004 and divorced in 2005.

The brief says Judy Lawless has been unable to prove that it would be detrimental to the girl’s well-being to be in her father’s custody.

“Madison has been doing exceptionally well in her father’s custody,” wrote Johnny Huckaby’s attorney, Ann Thompson, in the brief.

The week after Tracy police arrested Melissa Huckaby on suspicion of kidnapping, raping and killing Sandra, her ex-husband asked a judge to grant him custody of his daughter.

He included in his petition a copy of the criminal charges against Melissa Huckaby and accused her of having tried to commit suicide by swallowing razor blades.

Madison used to play with Sandra, her mother told the Tracy Press the day of her arrest. Madison was living with her mom and great-grandparents in Orchard Estates Mobile Home Park, where Sandra also lived, before her mother was jailed. After Melissa Huckaby’s arrest, Madison’s grandparents, Judy and Brian Lawless, took the girl to live with them in Cypress, according to court papers.

A judge in April granted Johnny Huckaby temporary custody of his daughter. Judy Lawless then asked the court to reconsider and allow her to keep the girl. She argued that Johnny Huckaby was an estranged father and lived 1,700 miles away for much of Madison’s life.

Johnny Huckaby in turn accused Judy Lawless of lying about Madison’s whereabouts to keep her from him. The court sided with him and Madison now lives in Arkansas with a step-brother, half-sister and a step-mom.

Prosecutors accuse Melissa Huckaby of murder with special circumstances of rape by instrument and kidnapping. They added charges that she drugged a 7-year-old girl in January and a 36-year-old Hayward man in March.

Sandra went missing on March 27. After a widespread search, farmworkers on April 6 found her lifeless body in a black suitcase. Police arrested Melissa Huckaby four days later.

The Stockton Record reported last week that prosecutors will take the case to a grand jury, which will reportedly convene on July 20.

TC, I agree with all you say. Makes one wonder if the same degree of denial occurred when dealing (or not dealing) with the obvious signs of MH's problems that escalated into what she did to Sandra.

Today in the Stockton Record it has an article in which Connie Lawless (MH grandmother) says "she has yet to hear any solid evidence in the case against Huckaby." I don't know what her definition of evidence is, but just to name a few:

* Melissa's suitcase goes missing same day Sandra goes missing

* Melissa goes to the hospital as a result of her swallowing something similiar to razor blades

* Melissa admitted to police killing Sandra "was an accident"

Thank GOD Madison is away from this disfunctional family. Her father stepped up and saved his little girl from who knows what.

Forgot to add this from previous article "She [Judy Lawless] said that after the media frenzy that followed her daughter Melissa Huckaby’s arrest on charges that she raped and killed 8-year-old Sandra Cantu, Lawless took Madison to a relative’s house in Grants Pass, Ore., to protect her from the chaos in Tracy."

Several past articles said relatives answered questions about Madison by saying she went with Judy ~"on a vacation that was planned long before all this". Not a major lie, but one has to wonder why this family has such a problem with straight truth - it would have been understandable if they said Madison was taken away to spare her from the chaos.

What happened to innocent Sandra is horrible, but her death may have spared her little friend from a horrible life. God be with her.

I was amazed the court decided this "quickly" (relative to usual speed of court cases) to grant full custody to Johnny Huckaby because it sounded like it would be messy - just reread this article and saw all that Judy Lawless told the court...

Either the woman was lying or didn't know the truth and was repeating what she'd been told by MH - it appears the court discounted what Lawless said. I'm so glad this little girl will be spared from growing up in the black muck within that family. Main question is still if Madison will get over being "sickly" - the current article makes it sound like she's doing very well. Chris87654

A agree with others - glad Madison will be away from the dysfunctional Lawless clan, and hope Mr. Huckaby will be a good father to her. Is good to read she's been doing "exceptionally well" at her father's home, and I still wonder if her being a "sickly child" (as described in past articles) was caused by MH. It was sad to read that Madison never went out to play with other kids, and almost sounds like Sandra was her only friend (I never heard of any other kids going over there, and seems the cops would have wanted to interview them/their parents).

So glad to hear she was removed from dysfunctional family!!! Praying that her father is a good man and will give her lot of patience and time during her emotional healing... she is truly confused now.. and needs loving security of a family... sighing.... she needs it!

Still sad Sandra Cantu did not have the opportunity to have the rest of her life.

plus the Huckaby family is not MH relatives...she is from the Lawless family....

I agree... finally that kid can get a fresh start. What a toxic environment to grow up in. I'll be praying for the Huckaby family. Not everyone does because of this thing but I think they are hurting just as much as everyone else is. I can't judge the Huckuby family from the sins of their daughter. Hopefully God will bring healing to them and especially for the Cantu family.

Thank God for taking this little girl far away from that environment and drama. The grandparent obviously do not have a reality check control. What can they offer this little girl of normalacy? Grandparents and no siblings to grow up with? She will now have a family and have a chance to live in peace without the drama that is about to go down. The grandparent will only lie to her about her biological mother which that is all she will ever be from now and drag her to court proceedings and teach her that they are victims.

At least we have one good court ruling on this case.
